Terms + Conditions
By entering our studio/premises, and/or purchasing a casual class, class pack, membership/contract, engaging in a workshop or similar you agree to our Terms and Conditions.
The Terms and Conditions will be displayed online on our website, located at www.peninsulaosteopathy.com.au/termsandconditions
Upon request we can provide you with a hard copy – please ask one of our reception staff to assist you.
Our Terms and Conditions can be amended at any time.
You should familiarise yourself with these Terms and Conditions and check for updates regularly. We will notify you in writing of any changes to the Terms and Conditions by e-mail, on our website or otherwise at the Studio.
Conditions of Entry
Every possible effort is made to deliver classes and services on time as advertised.
Class Schedules are subject to change or cancellation however we are not required to provide notice to you of such changes.
All purchases are final and Peninsula Osteopathy + Allied Health does not offer refunds on services or products for change of mind, injury, illness, change of address or any other reason including change of schedule or if you are unable to attend a class because it is at capacity.
All passes and memberships are non-transferable or interchangeable.
We reserve our right to change our opening hours on any given day without notice to you. You will be notified of any permanent changes to our opening hours.
You must present, if requested, your valid photo identification or concession card to reception staff or representative of the Studio upon entry to our studio or clinic. We reserve the right to refuse entry to persons without suitable ID.
We reserve the right to refuse entry to, or eject you from our premises in the event that you are behaving in an anti-social, intoxicated, disorderly, aggressive, offensive or dangerous manner or in any manner which impacts the security of our students or other people at the studio/clinic.
Once a class begins the studio door will be locked to ensure the least amount of disruption to our students and to maintain safety of participants. Late entry will not be permitted under any circumstance. We recommend that you arrive at least 5 minutes before the scheduled time of a class to avoid disappointment. For your own wellbeing we advise that you must remain in the studio until a class concludes.
We are not responsible in any way for the safekeeping of your personal belongings that you bring into our studio. We recommend that you only bring items required for your class and leave your valuables at home.
No items (including phones and keys) are permitted in the yoga rooms apart from a mat, studio equipment, water bottle and towel.
Items that are left in our change rooms or lockers will be held for two weeks after being found, following this period they will either be donated to charity or otherwise disposed.
Fit for Purpose Conditions
All the teachers at PO+AH Pilates and Yoga are qualified instructors or practitioners in their recognised modality.
To minimise risk to students and participants, it is expected that participants always follow the instruction of the teacher/s.
Students are advised to seek medical advice prior to commencing any exercise program and it’s your responsibility to seek medical advice prior to commencing a class.
Participating in any form of exercise at our studio is done entirely at your own risk.
You must advise us and any instructors if there are any risks to your health by participating in our classes this includes a pre-existing injury, illness, and pregnancy, prior to attending our studio.
Where you have a Medical Condition, we require you to seek approval from a medical practitioner to participate in any of our classes. Written approval may be requested prior to class.
Participating in any form of exercise at our studios with a medical condition is done entirely at your own risk.
Students are asked to bring their own equipment including mat to class, or to wipe down their studio supplied mats and/or equipment using a supplied towel/cloth with the supplied cleaner after all classes in order to maintain hygiene standards.
As per our COVID safe plan, all equipment and frequently touched surfaces are regularly cleaned and disinfected.
Smoking is prohibited inside and out of the front of our studio.
Attending classes under the influence of alcohol, drugs or when affected by medications is also prohibited.
Communications
We will predominantly only communicate with you relevant information to your services and membership. This will primarily be done electronically via Wellness Living, our business email or associated systems. From time to time we may contact you via phone to confirm your attendance or membership information.

Membership & Pricing Conditions
In order to obtain a membership, you must be 18 years of age or over. Minors aged over 15 years and under 18 years may obtain a membership, but only if their parent or guardian has provided formal consent.
The sale of each membership is subject to specific terms and conditions applicable to the specific membership which can include
– a minimum membership commitment period,
– automatic direct debit,
– membership time limitations and/or
– class attendance limitations.
Class packs and unlimited memberships exclude attendance at guest teacher’s classes, workshops, retreats, teacher training or other special events.
Memberships are sold to patrons of our studio for personal use only. Memberships may not be shared or transferred for any reason at any time. Anyone sharing memberships does so expressly without the consent of Peninsula Osteopathy + Allied Health will be denied all future entry and forfeit their membership.
We have the right to change our fees for new memberships at any time. We will notify you of any changes to the pricing of memberships in writing.
We also reserve the right to increase membership costs at any time after the applicable minimum commitment period for your membership. We will notify you in writing of any changes to the pricing details of your membership.
If you are paying for your membership by direct debit, you authorise us to debit any increased fee amounts from your nominated bank account. If you do not agree to any pricing changes, you may cancel your membership in accordance with these Terms and Conditions.
To receive the eligible concession rates on membership packages that have a discounted rate a current student ID, pension card or healthcare card must be presented at the time of purchase of the concession-priced membership.
Membership type, specific conditions and terms including costs
Casual Classes
The activation date is the date of the first class booked or attended on the pass. No refunds, transfers, suspensions or extensions are offered due to illness, injury, change of address or any other reason. Multiple casual classes can be purchased simultaneously. $25 per Studio class $30 per Reformer class
7 Day Introductory Offer
Peninsula Osteopathy + Allied Health Introductory Offer is valid for 7 days from the pass activation date. The activation date is the date of the first class booked or attended on the pass, herein referred to as the ‘Activation Date’.
The Intro Offer allows you to attended an unlimited* number of regularly scheduled classes during the 7 days from and including your activation date.
The Intro Offer is available for new members, or returning members who have not been back for over 12 months. This membership cannot be suspended under any circumstances and no concession price is available.
$50 per offer
5 Class Packs
All 5 class packs have a 3-month expiry date. The activation date is the date of the first class booked or attended on the class pack and the class pack will expire 3 months from the activation date. Class packs cannot be shared, transferred or extended beyond their expiry date. This includes Therapeutic Yoga course.

10 Class Packs
All 10 class packs have a 6-month expiry date. The activation date is the date of the first class booked or attended on the class pack and the class pack will expire 6 months from the activation date. Class packs cannot be shared, transferred or extended beyond their expiry date.

Weekly Direct Debit
The weekly direct debit membership has a minimum term of eight weeks from the date that the holder purchases the membership from PO+AH Pilates + Yoga.
After eight consecutive weeks, the memberships will automatically continue on a weekly basis until termination of the membership.
The weekly direct debit membership allows you unlimited regularly studio classes and/or reformer classes (dependant on the type of membership purchased) but excludes guest teachers, workshops, retreats, teacher training, or other special events.
$39 per week unlimited studio classes membership.
$39 per week for limited reformer membership (up to 2 classes per week).
$63 per week for unlimited studio classes AND reformer membership (up to 2 classes per week).
One Month Unlimited Studio Membership
The 1 Month Unlimited membership is valid for 1 month as stated on purchase. The activation date is the date of the first class booked or attended on the pass.
This membership allows you unlimited regularly studio classes and/or reformer classes (dependant on the type of membership purchased) but excludes guest teachers, workshops, retreats, teacher training, or other special events.
No refund is available on pre-paid memberships
This membership cannot be suspended under any circumstances and no concession price is available.
$159 per month for studio classes
One Month Limited Reformer Membership
The 1 Month Limited Reformer membership is valid for 1 month as stated on purchase. The activation date is the date of the first class booked or attended on the pass.
This membership allows you up to two reformer classes per week but excludes guest teachers, workshops, retreats, teacher training, or other special events.
No refund is available on pre-paid memberships
This membership cannot be suspended under any circumstances and no concession price is available.

Upfront 6 Month Unlimited Membership (coming soon)
The 6 Month Unlimited membership is valid for 6 months as stated on purchase. The activation date is the date of the first class booked or attended on the pass.
This membership allows you unlimited regularly studio classes and/or reformer classes (dependant on the type of membership purchased) but excludes guest teachers, workshops, retreats, teacher training, or other special events.
This membership can be suspended for up to 3 weeks in increments of 1 week.
No refund is available on pre-paid memberships but one transfer of name is allowed with a $50 administration fee charged.

The 12 Month Unlimited membership is valid for 12 months as stated on purchase. The activation date is the date of the first class booked or attended on the pass.
This membership allows you unlimited regularly studio classes and/or reformer classes (dependant on the type of membership purchased) but excludes guest teachers, workshops, retreats, teacher training, or other special events.
This membership can be suspended for up to 6 weeks in increments of 1 week.
No refund is available on pre-paid memberships but one transfer of name is allowed with a $50 administration fee charged.

All services will be deactivated if an account becomes more than 14 calendar days late.
Weekly fees will be charged via your authorised automatic credit/debit card or nominated bank account by QuickPay/PayChoice, our nominated third-party payment provider.
It is the holder’s responsibility to ensure there are sufficient funds available in their nominated bank account or credit card to cover the applicable fees for the direct debit memberships.
You will be notified if your credit card or bank account payment fails to authorise for any reason, and an late fee will apply if a valid credit card or authorised bank account is not provided within 7 calendar days of the original rejection date.
This fee is charged by QuickPay/PayChoice directly and will not be absorbed by Us. Please note your credit card statement will show “PO+AH Pilates + Yoga” for all QuickPay/PayChoice payments and this will indicate your payment to Us.
Following the minimum 8 week commitment, direct debit memberships may be suspended up to three times a year via email to info@peninsulaosteopathy.com.au
The minimum suspension period is one week and the maximum for 6 weeks for any single suspension period.
Suspensions are granted for a maximum of 6 weeks per calendar year.
Members must provide five working days’ notice to allow a suspension to be activated.
To terminate the direct debit membership we must be advised by the membership holder via e-mail sent to info@peninsulaosteopathy.com.au that they wish to terminate the relevant membership. Two weeks’ notice is required on the cancellation of a direct debit membership.
By creating a direct debit membership, the holder agrees to the terms and conditions of our third-party biller, currently QuickPay/PayChoice. QuickPay/PayChoice terms and conditions can be found in hard copy at reception for our reception or our website peninsulaosteopathy.com.au
Private classes
Confirmation of Private Class booking is secured upon payment. Notice of cancellation must be in writing and provided to Us with 24 hours’ notice.
Events
Workshops and Events have no refunds, cancellations, exchanges or transfers.
Class Attendance
We have a policy in place to ensure everyone has a chance to practice.
You must pre-book your attendance to any Peninsula Osteopathy + Allied Health classes using the online booking system available on our website or Wellness Living. This is required in order to ensure that there is sufficient space for students to attend a class. You may attend our studios prior to the start of any scheduled class and participate in that class, where there is sufficient availability and space to be determined at our discretion. We cannot guarantee participation if you don’t book prior to class starting.
Cancellation Conditions
Our cancellation policy for PO+AH Pilates + Yoga:
Class cancellations can be made via peninsula osteopathy Wellness Living site or the Wellness Living Achieve mobile app.
Class cancellations can be made up to 3 hours prior to your class start time without penalty.
Class cancellations of Early Morning classes (those prior to 8 am) can be made up to 9 hours prior to your class start time without penalty.
People on a Direct Debit Membership, 7 Day Intro Offer or any unlimited membership who pre-book a class and cancel inside of the Late Cancel or the respective 3 or 9-hour window will incur a $10.00 charge.
People on a Direct Debit Membership, 7 Day Intro Offer, or any unlimited membership who pre-book a class and do not attend will incur a $15.00 charge
People using a single pass, 5 or 10 Class Pass who pre-book a class but cancel inside of the Late Cancel window or fail to attend will forfeit their class.
Cancellations will not be accepted via email or social media. Phone cancellation must be within business hours, and the above cancellation windows.
Contact & Privacy Conditions
You must inform us when your contact details change so we can keep in touch with you. Please review your details regularly, as this is the quickest and easiest way for us to make contact with you should the need arise.
Peninsula Osteopathy + Allied Health complies with the Privacy Act. If you wish to request access to your personal information, correct or update your details or raise any privacy concerns you may have, please contact us at info@peninsulaosteopathy.com.au

Our privacy policies govern your use of our services.
Peninsula Osteopathy + Allied Health uses a third party software provider known as Wellness Living. In order to create a membership, your personal information will be provided to the proprietor of Wellness Living. The collection and use of personal information by Wellness Living is governed by Wellness Living’s privacy policy, which can be viewed on their website.
Marketing and materials
Permission to use materials (such as brochures, press releases, social media posts) from Us is granted, provided that the use of the materials is for informational, non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media.
You agree not to distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of PO +AH Pilates and Yoga in any way.
Except as expressly authorized by Us in writing, you may not reproduce, sell or exploit for any commercial purposes any part of Our services
You agree to indemnify, defend and hold harmless PO +AH Pilates and Yoga for any and all unauthorized uses you may make of any material on this site. You acknowledge the unauthorized use of the contents could cause irreparable harm to PO +AH Pilates and Yoga and that in the event of unauthorized use, PO +AH Pilates and Yoga shall be entitled to an injunction in addition to any other remedies available at law or in equity.
Our Liability
Peninsula Osteopathy + Allied and its representatives will not be liable and excludes all liability under these Terms and Conditions or in any other way for all injury, illness, damage or loss of any kind whatsoever directly or indirectly sustained by you in relation to participating in any class or entering the Studios. You herby agree to release Peninsula Osteopathy + Allied and its Representatives from all claims relating to a Membership, participating in any Class or from otherwise entering the Studios.
Below is the risk warning and liability disclaimer all participants must read and agree to PRIOR to participation.
PENINSULA OSTEOPATHY AND ALLIED HEALTH PILATES AND YOGA (referred to as Peninsula Osteopathy)
Risk Warning and Liability Disclaimer
You must read this Risk Warning and Disclaimer and agree to be bound by the acknowledgements and indemnity.
You acknowledge and agree that –
- I am participating in a Yoga Class, Pilates Class, Workshop, or Pre-assessment Yoga/Pilates session offered by Peninsula Osteopathy and Allied Health, during which I will receive information/ instruction about Yoga/Pilates.
- Yoga/Pilates may require some physical exertion, which may be strenuous and can cause physical
- Despite professional precautions, risks may include but are not limited to:
- risks inherent in my health condition
- accidental movement or imbalance including by another participant
- normal risks involved in attending premises
- immediate medical care may not be available if needed
- Some risks are unforeseeable even with care.
- Care in provision of services does not replace my need to use good judgment and common sense about my fitness and safety and I share responsibility for the safe conduct of my Yoga/Pilates sessions.
- It is my responsibility to consult with a physician regarding my fitness for safe participation in the Yoga/Pilates Class, Workshop, or Pre- assessment yoga/Pilates session.
- I am physically fit and I have no medical condition, which would prevent my full participation in such exercise and I will advise in writing if that changes.
- No services are treatment for any health condition or providing any particular outcome and any discussion of the benefits of Yoga/Pilates participation is not allied health or medical advice.
- I am responsible for care of my personal items when attending and will not leave valuables unattended.
- I will provide at least 24 hours’ notice through the app or by telephone to 03 5253 2345 to cancel or request another class/time if I need to cancel any participation or pay the usual charge.
- In the event of an emergency, I authorise an Peninsula Osteopath the personnel to seek immediate medical assistance.
In summary and more formal language, to the full extent that the law permits –
- I assume full responsibility for risks and waive Peninsula Osteopathy’s liability.
- I indemnify Peninsula Osteopathy to the full extent permitted by law should I make any claim for any personal or property harm or loss or in connection with participating in Yoga/Pilates (including hot or warm temperature Yoga/Pilates and other classes) or any cause.
- Each of these acknowledgements are independent terms and they do not operate to exclude the Consumer Guarantees and any remedies that may apply under the Australian Consumer Law. To the extent that law permits, your liability to me will not exceed providing the services as agreed or payment not exceeding the cost providing the services again.

Privacy Statement
Privacy at a glance
The provision of safe and quality osteopathic care is our principal concern. This requires a strong relationship between the osteopath and the patient based on trust and confidentiality.
Your osteopath/instructor regards your health information as confidential. Your personal information is handled in accordance with the practice’s privacy policy and is consistent with Commonwealth and State/Territory law.
You are entitled to know what personal information is held about you; how and under what circumstances it may be disclosed; when consent is required for these purposes; and how it is stored.
We will discuss these matters with you at the time your health information is collected while attending this practice.
Clinical records are stored and transmitted securely and safeguarded against loss or damage.
Access to your information
You have the right to access your information. You may ask to view the information or ask for a copy of a part or of the whole record. You are not required to give reasons, but you may be asked to clarify the scope of the request.
Often a request will need to be in writing. Access to some information may be limited in some circumstances, but in such an event we will advise you of the reasons.
At your request, your health information held by this practice will be made available to another health service provider.
Under the Privacy Principles, the practice may charge a fee if it incurs costs in providing access, particularly if records need to be copied. Typically, it’s about $25 but may be higher for larger files.
If you find that the information held is not accurate or complete, you may have that information amended accordingly.
Parents/guardians and children
Although this may surprise some parents, privacy laws apply to children as well as adults. Under the Privacy Guidelines, a child’s right to privacy of their health information may at times restrict access by parents/guardians to that same information.
Collection, use, and disclosure of your health information
Osteopaths must keep clinical records. It’s a government requirement, and information about your medical and family health history is needed to provide accurate diagnoses and appropriate treatment.
We will only seek information that is relevant to your health. This information is generally collected directly from you or otherwise with your consent. However, from time to time we may receive information from others (for example, X-ray images and referrals from other practitioners). When this occurs, we will wherever possible make sure you know we have received this information.
Some information about you may be provided to Medicare or your private health insurer, if relevant, for billing and rebate purposes. This information generally does not include your detailed clinical records but may depend on the terms of your insurance policy.
There are circumstances where a health practitioner is legally required to disclose information. An example of this is a subpoena or other mandatory reporting requirements.
Generally, workers compensation and traffic accident schemes require patients treated under those schemes to agree their health information can be shared with the scheme and its insurers.
It is necessary for us to keep your health information for as long as is required by law (generally 7 years after your last consultation, but longer in some circumstances).
We will inform you if we intend to transfer your clinical records to another osteopath or clinic, or if we sell or close this clinic.
